Terms of Service

These Terms govern your access to and use of RecTrack and explain the legal relationship between users, organizations, and platform operator.

Summary

RecTrack is operated by Nuz Development LLC. Organizations using RecTrack are solely responsible for the operation, safety, and legal compliance of their events.

RecTrack provides software and payment-enablement infrastructure, but RecTrack does not control in-person event operations unless explicitly agreed in writing.

By using the Services, you agree to these Terms and our Privacy Policy.

1. Agreement to Terms

These Terms of Service are a binding legal agreement between you and Nuz Development LLC ("RecTrack," "we," "us," or "our") regarding your use of the RecTrack websites, apps, and related services (the "Services").

If you access or use the Services on behalf of an organization, you represent and warrant that you have authority to bind that organization.

2. Eligibility and Minors

You must be legally able to enter into these Terms. Users under 18 may require guardian approval for account use, registration, participation, and payment actions.

For children under 13, verifiable guardian consent is required before account activation and personal data processing consistent with COPPA-related controls.

3. Accounts and Security

You are responsible for maintaining account credential confidentiality and all activity occurring under your account. You must provide accurate account data and keep it updated.

Report suspected unauthorized access immediately to support@rectrack.app.

4. Platform Role and Organization Responsibility

RecTrack provides software and payment-enablement tools. RecTrack is not the event operator, venue manager, on-site supervisor, referee, trainer, or safety manager unless explicitly stated in a signed written agreement.

Each organization is solely responsible for event operations, including:

  • Rules, eligibility, scheduling, staffing, supervision, and participant conduct.
  • Venue safety, permits, emergency procedures, and legal compliance.
  • Participant disclosures, waivers, releases, and required notices.
  • Refund decisions, complaints, and participant-facing dispute handling.

5. Payments, Billing, and Fees

Services may include subscription billing and competition registration payments. For registration charges processed through connected payment accounts, the organization is the merchant/seller for its events.

RecTrack may charge a platform/application fee for payment facilitation. Organizations set event pricing and refund policies subject to law and are responsible for event fulfillment.

6. Waivers and Sports Risk

Sports and recreational activities involve inherent risk of injury, illness, property damage, and death. Participants assume these risks.

Organizations are responsible for ensuring required waivers and parental consents are obtained and legally sufficient.

7. Intellectual Property and Content

You retain ownership of your submitted content. You grant RecTrack a non-exclusive, worldwide, royalty-free license to host, process, and display your content as necessary to operate and improve the Services.

RecTrack and its licensors own the Services, software, and branding. You may not copy, reverse engineer, or misuse the Services except as permitted by law and these Terms.

8. Disclaimers and Liability Limits

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" TO THE MAXIMUM EXTENT PERMITTED BY LAW.

RecTrack disclaims all implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement.

To the maximum extent permitted by law, RecTrack is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business interruption.

To the maximum extent permitted by law, RecTrack's aggregate liability will not exceed the greater of (a) amounts paid to RecTrack in the prior 12 months, or (b) USD $100.

9. Indemnification

You agree to defend, indemnify, and hold harmless RecTrack and its affiliates, officers, directors, employees, and agents from claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services, your content, your violation of law, or your violation of these Terms.

10. Disputes, Arbitration, and Governing Law

Before filing a claim, you agree to attempt informal resolution by sending written notice to legal@rectrack.app and allowing 30 days to resolve the issue.

Any unresolved dispute will be resolved by binding individual arbitration, except matters eligible for small claims court. Class, collective, and representative actions are waived to the extent permitted by law.

These Terms are governed by Michigan law. Any court proceeding permitted under these Terms must be brought in Oakland County, Michigan, unless applicable law requires otherwise.
